1.1Introduction and Acceptance
These Terms of Service (the "Terms") govern access to and use of POSTARYX, a web-based social media management service operated by Lunark Dynamics LLC, including its websites, dashboards, workspaces, APIs, integrations, publishing tools, analytics, media features, support services, and related functionality (collectively, the "Service").
By creating an Account, accepting an invitation to a Workspace, accessing or using the Service, connecting a third-party account, initiating an OAuth authorization, purchasing or renewing a subscription, or otherwise indicating acceptance of these Terms, you agree to be bound by these Terms and the policies incorporated by reference. If you do not agree, do not access or use the Service.
If you use the Service on behalf of a company, agency, client, partnership, nonprofit, or other organization, you represent that you have authority to bind that organization to these Terms. In that case, “you” and “your” include the organization and its authorized users, as applicable.
1.2Definitions
“Account” means the user-level login or identity used to access POSTARYX.
“Workspace” means a shared Service environment containing users, roles, Connected Platforms, content, media, schedules, settings, billing information, and other workspace data.
“Workspace Administrator” or “Admin” means a user granted administrative authority within a Workspace, including authority to invite/remove users, configure integrations, manage billing or permissions, and take other actions made available to that role.
“Connected Platform” means a third-party social media, publishing, messaging, community, business-listing, blogging, streaming, or similar service that a user connects to POSTARYX.
“Platform Data” means data received from, sent to, or generated in connection with a Connected Platform, including account identifiers, profile or Page information, posts, media, analytics, comments, permissions, publishing status, and integration metadata.
“OAuth Data” means authorization information associated with a Connected Platform, including access tokens, refresh tokens, scopes, token expiration information, authorization codes, account IDs, and related connection metadata.
“User Content” means content or material you or your Workspace submit, upload, import, create, schedule, publish, transmit, or otherwise make available through the Service, including text, captions, images, audio, video, links, files, comments, drafts, and metadata.
“Plan” means a free, trial, paid, enterprise, promotional, beta, or other Service tier with the features, limits, prices, and billing terms presented when selected.
1.3Who We Are
POSTARYX is operated by Lunark Dynamics LLC, [State of Formation] limited liability company, with a registered address at [Registered Address]. References in these Terms to “POSTARYX,” “Lunark Dynamics LLC,” “we,” “us,” or “our” mean Lunark Dynamics LLC as the legal operator of the Service unless the context requires otherwise.
POSTARYX is independently operated. Except where we expressly state otherwise in writing, neither POSTARYX nor Lunark Dynamics LLC is affiliated with, endorsed by, sponsored by, or operated by Postiz, Gitroom, Meta, Facebook, Instagram, Threads, LinkedIn, Microsoft, TikTok, ByteDance, Google, YouTube, Pinterest, Reddit, X, or any other third-party platform or service. Third-party names and marks belong to their respective owners.
1.4Eligibility and Authority
- You must be at least 18 years old, or the age of legal majority where you live if higher, and legally capable of entering into a binding agreement.
- If you use the Service for an organization or client, you must have authorization to act for that organization or client, including authorization to connect and manage its Connected Platforms.
- You may not use the Service if applicable law prohibits you from receiving it, if your use would cause us to violate applicable sanctions or export-control rules, or if we have previously terminated you for material abuse and have not authorized your return.
- You must provide accurate account, billing, business, and contact information and keep it current.
1.5Account Registration and Security
You are responsible for safeguarding login credentials, authentication factors, recovery methods, API credentials, Workspace invitations, and any device or browser session used to access the Service. You must not share personal login credentials except through Service-supported team access mechanisms.
- Use a unique, strong password and any available multi-factor authentication features appropriate to your risk.
- Promptly notify us at [Security Email or Security Contact Process] if you suspect unauthorized access, credential compromise, or misuse of your Account or Workspace.
- You are responsible for activity performed through your Account or by users you invite, except to the extent caused by our breach of these Terms or applicable law.
- We may require reauthentication, additional verification, password reset, or temporary access restrictions where reasonably necessary to protect the Service, users, Connected Platforms, or third parties.
1.6Workspaces, Teams, Agencies, and Clients
A Workspace may contain multiple users with different roles and permissions. Workspace Administrators are responsible for assigning appropriate access, removing users who no longer require access, confirming that users are authorized to manage Connected Platforms, and maintaining appropriate internal approval processes.
If you are an agency, consultant, contractor, or service provider managing accounts for a client, you represent that you have current authority from that client to connect its accounts, publish or schedule User Content, retrieve permitted analytics, and perform any other requested action. You remain responsible for your contractual and legal relationship with your clients.
Workspace users may be able to view or act on content, analytics, media, or Connected Platforms according to their assigned permissions. The Workspace customer is responsible for configuring roles consistent with its confidentiality, privacy, and client obligations.
1.7The Service
The Service may provide content planning, drafts, content calendars, scheduling, publishing, media storage, platform connection management, analytics, team collaboration, approvals, queues, retries, notifications, APIs, automation hooks, and other social media management functions. Features vary by Plan, Connected Platform, account type, region, platform approval status, API access level, and technical availability.
A connector displayed in POSTARYX may be live, beta, experimental, temporarily unavailable, awaiting platform approval, limited to certain accounts, or subject to third-party restrictions. We may label feature status in the Service or documentation. No marketing statement should be read as a guarantee that every integration is available to every user at all times.
We may add, remove, modify, suspend, limit, or discontinue Service features, Plans, integrations, quotas, or technical requirements. We will provide notice where reasonably practicable for material changes that adversely affect paid users, but urgent changes may be necessary without advance notice when required by law, security concerns, platform policy, API deprecation, platform suspension, or third-party outage.
1.8Third-Party Platform Dependency
Connected Platforms are independent services. Your access to a Connected Platform through POSTARYX depends on the platform continuing to make the relevant API, OAuth products, permissions, account types, quotas, and approval status available. Platforms may change terms, pricing, APIs, review requirements, permissions, rate limits, media rules, moderation practices, or account eligibility at any time.
We do not control and are not responsible for a Connected Platform’s outages, moderation or enforcement decisions, rejected or delayed posts, API errors, rate limits, content review, account suspension, token revocation, quota changes, pricing, feature deprecation, business verification, or refusal to approve or continue an integration.
If a Connected Platform changes or revokes access, we may suspend or modify the affected connector, disable scheduled actions, require reauthorization, or discontinue the integration. Where feasible, we may provide status notices or connection-health alerts, but we do not guarantee advance warning from the platform.
1.9OAuth Authorization and Connected Accounts
When you choose to connect a third-party account, you authorize POSTARYX through the platform’s OAuth or other approved authorization process. The platform presents the requested permissions or scopes. You decide whether to grant them. POSTARYX may access or act on the connected account only to the extent permitted by the credentials and permissions granted and by the features you use.
- We should request only permissions reasonably necessary for enabled functionality, subject to platform requirements and future feature changes.
- You can disconnect a Connected Platform through POSTARYX where that control is available and can also revoke access from the platform’s own permissions or security settings.
- Disconnecting a platform may prevent scheduled posts, publishing, analytics, comments, inbox, or other related features from working.
- Where supported by the platform and implemented in production, disconnection is intended to revoke or invalidate the upstream authorization and delete the active token or credential stored by POSTARYX. Implementation must be verified for each connector.
- Some platforms require periodic reauthorization, refresh, or renewed permissions. You are responsible for completing reconnect prompts when required.

1.10Platform-Specific Conditions
1.10.1Meta — Facebook Pages, Instagram, and Threads
You may use POSTARYX only with Facebook Pages, Instagram accounts, Threads profiles, and other Meta assets that you are authorized to administer or manage. You must not use POSTARYX to evade Meta’s account, permission, publishing, advertising, rate-limit, or automation rules.
Where an Instagram publishing feature requires a Professional account, public media URL, particular media format, or other platform-side eligibility condition, you are responsible for maintaining an eligible account and compliant content. POSTARYX does not guarantee that a personal or otherwise ineligible account can publish through the API.
POSTARYX is intended for user-directed content management and publishing. Unless a feature is expressly offered and approved, you may not use the Service to automate likes, follows, deceptive engagement, or other restricted behavior.
1.10.2LinkedIn
LinkedIn integrations are intended for legitimate scheduling, publishing, Page management, profile posting where supported, and other approved community-management functions. You must not use POSTARYX to scrape LinkedIn, extract or build lead lists from LinkedIn data, create unauthorized datasets, perform prohibited aggregation, or engage in automation-at-scale that violates LinkedIn’s terms or developer restrictions.
You must have authority to manage the LinkedIn profile or Page you connect. If a feature displays member information associated with comments or engagement, you must use that information only for legitimate functionality made available through the Service and not for prohibited profiling, sale, or enrichment.
1.10.3TikTok
TikTok publishing remains subject to TikTok’s account eligibility, application approval, publishing UX, media-domain, privacy-setting, commercial-content, music, and other requirements. You are responsible for actively selecting available privacy options and reviewing any commercial-content or branded-content disclosures presented before publishing.
You must not use POSTARYX to copy arbitrary content from other platforms to TikTok in violation of platform rules, bypass required user consent, obscure required disclosures, or share developer/API credentials across unrelated clients where prohibited.
1.10.4Pinterest
Pinterest integrations may be subject to platform-specific limits on caching or retaining API-derived data. POSTARYX may minimize or refresh Pinterest-derived board, Pin, account, or other metadata instead of retaining it indefinitely. Features may be limited to comply with Pinterest’s developer requirements.
1.10.5Google, YouTube, and Google Business Profile
Google and YouTube integrations are intended for authorized account/channel management, publishing, uploads, analytics, or business-profile management made available through approved APIs. You must not use POSTARYX to bypass YouTube download restrictions, create unofficial downloading functionality, evade quota limits, or access Google data without appropriate authorization.
Where video display is offered, POSTARYX may be required to use official player or API mechanisms. You remain responsible for rights in uploaded media and for your channel, listing, or business account complying with platform rules.
1.10.6Reddit
You are responsible for the rules, flair requirements, karma requirements, cooldowns, community norms, and moderator requirements of each subreddit or community in which you publish. You must not use POSTARYX to mass-post substantially identical content across communities in a manner that constitutes spam or platform manipulation, or to evade rate limits or moderator restrictions.
Commercial Reddit API access may depend on written approval or other platform requirements. POSTARYX may limit, disable, or withhold Reddit functionality until the necessary access conditions are satisfied.
1.10.7X
X functionality may use POSTARYX-managed developer credentials, user OAuth authorization, customer-supplied developer credentials, or another model disclosed in the Service. If you supply your own developer credentials, you are responsible for your developer account, platform charges, policies, spending controls, and accuracy of the credentials, and you authorize POSTARYX to store and use them solely to provide the requested integration.
X API pricing or access terms may affect usage limits, add-ons, or availability. We will disclose any direct POSTARYX charge before charging you.
1.10.8Other Integrations
Other integrations may use OAuth, API keys, application passwords, access tokens, per-instance credentials, bot tokens, or cryptographic keys. You must provide only credentials you are authorized to use and must not submit a private key, password, or token to a connector unless the Service specifically requests that credential for that connector.
Experimental or beta integrations may rely on unstable or unofficially evolving APIs. They may fail, change, or be removed without the reliability expected from mature connectors.
1.11User Content Ownership
As between you and Lunark Dynamics LLC, you retain ownership of your User Content and any intellectual-property rights you have in it. These Terms do not transfer ownership of your User Content to us.
You acknowledge that copies of published User Content may remain on Connected Platforms, recipient devices, caches, archives, search engines, or third-party systems after you remove the original from POSTARYX. Removal from POSTARYX does not by itself delete content already delivered to a Connected Platform.
1.12Limited License to POSTARYX
You grant Lunark Dynamics LLC a worldwide, non-exclusive, royalty-free, sublicensable solely to service providers and Connected Platforms as necessary, limited license to host, store, reproduce, encode, transcode, resize, format, cache, transmit, display, process, and publish User Content only to provide, operate, secure, maintain, support, troubleshoot, and improve the Service and to carry out actions you request.
This license includes sending User Content and relevant metadata to a Connected Platform you select, generating previews and thumbnails, processing media into platform-compatible formats, maintaining scheduled jobs and publishing status, and creating operational logs reasonably necessary to provide the Service. It ends when the content is deleted from active systems, subject to backups, legal retention, platform-side copies, and technical deletion cycles described in the Privacy Policy.
1.13Your Content and Compliance Responsibilities
- You must have all rights, permissions, licenses, consents, and lawful bases necessary to upload, process, schedule, publish, analyze, or otherwise use User Content and related personal data through the Service.
- You are responsible for reviewing content before publication, including factual accuracy, intellectual-property rights, privacy/publicity rights, advertising disclosures, sponsorship disclosures, contest rules, regulated-industry requirements, accessibility considerations, and platform-specific policies.
- You must not direct POSTARYX to publish content to an account, Page, channel, community, or other asset you are not authorized to manage.
- If you process personal data on behalf of clients, customers, followers, employees, or other individuals, you are responsible for notices, contracts, lawful bases, consents, and data-subject handling required for your role.
1.14Optional AI-Assisted Features
POSTARYX may introduce optional AI-assisted features in the future. Unless and until a feature is enabled in production and the Privacy Policy and subprocessor disclosures identify the relevant provider and data flow, these Terms do not represent that an AI provider is currently processing User Content.
If AI-assisted features are enabled, AI output may be inaccurate, incomplete, misleading, offensive, repetitive, or infringing. You will remain responsible for reviewing, editing, approving, and publishing any output, and we may impose usage limits, disclosures, or provider-specific terms.
1.15Subscriptions, Billing, and Automatic Renewal
- Paid Plans, billing cycles, prices, included usage, and limits are shown at checkout, on the pricing page, in an order form, or in another written agreement.
- By purchasing a recurring subscription, you authorize Lunark Dynamics LLC and [Actual Payment Provider or Merchant of Record] to charge the selected payment method for recurring fees, applicable taxes, and other amounts expressly disclosed at purchase.
- Unless otherwise stated, subscriptions renew automatically for successive billing periods until canceled before the next renewal date.
- You are responsible for maintaining a valid payment method and accurate billing information.
- We may change Plan prices or limits for future billing periods by providing notice required by applicable law and, where feasible, at least 30 days’ notice for material price increases to recurring paid subscriptions.
- Platform-imposed costs, quotas, or API pricing may affect connector availability or future Plan design. We will not impose undisclosed third-party pass-through charges on your payment method.
1.16Free Trials, Free Plans, Beta, and Experimental Features
We may offer trials, free Plans, promotional limits, previews, beta features, or experimental connectors. We may modify or discontinue them at any time, subject to applicable law. Beta and experimental features may be incomplete, less reliable, or subject to sudden third-party API changes.
A feature labeled “in review,” “beta,” “experimental,” “limited,” or “temporarily unavailable” is not a promise of future approval, general availability, or uninterrupted operation.
1.17Refunds
The Refund Policy is incorporated into these Terms. Unless a written order form or mandatory law says otherwise, the V2 baseline is a refund of the first paid subscription charge only when requested within seven (7) calendar days after that charge and when the account satisfies the eligibility requirements in the Refund Policy.
Renewals, partial billing periods, heavy or abusive use, third-party fees, custom services, and other excluded items are handled as stated in the Refund Policy.
1.18Cancellation
You may cancel a recurring subscription at any time using available billing controls or by contacting [Support Email]. Cancellation prevents future renewal but does not by itself delete your Account, Workspace, User Content, or Connected Platform data. Unless a refund is approved or required by law, access ordinarily continues until the end of the current paid billing period.

1.19Taxes and Third-Party Charges
Fees are exclusive of taxes, duties, levies, bank fees, foreign-exchange fees, card-network charges, and similar amounts unless checkout states otherwise. You are responsible for taxes legally imposed on your purchase except taxes based on our net income. Where required, our payment provider or we may collect tax information and calculate or remit taxes.
You are also responsible for charges owed directly to a Connected Platform or developer provider under accounts or credentials you control, including any API or usage charges associated with a bring-your-own-key model.
1.20Acceptable Use
You must comply with the Acceptable Use Policy. Without limiting that policy, you may not use the Service for spam, deceptive automation, fake engagement, scraping prohibited by a platform, credential theft, malware, unlawful content, rights infringement, rate-limit evasion, platform manipulation, or activity likely to cause suspension of our shared developer credentials or other users’ access.
1.21API, Automation, Rate Limits, and Fair Use
If the Service exposes an API, webhook, automation interface, or bulk feature, you must follow documented limits and must not circumvent technical controls. We may throttle, queue, delay, reject, or suspend requests to maintain system integrity, comply with Connected Platform limits, or prevent abuse.
Usage limits may be applied per user, Workspace, account, connector, Plan, media volume, API call, or other reasonable unit. Repeatedly creating accounts or Workspaces to evade a limit is prohibited.
1.22Intellectual Property, Brand, and Open Source
Except for User Content, third-party materials, and open-source components, the Service, POSTARYX brand, website, hosted service configuration, documentation, design, and commercial materials are owned by Lunark Dynamics LLC or its licensors and are protected by applicable intellectual-property laws.
Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to use the hosted Service for your internal or client-management business purposes during the applicable subscription period.
POSTARYX includes or may include open-source software. Open-source components remain governed by their applicable licenses, and nothing in these Terms is intended to restrict rights that an applicable open-source license grants you.
POSTARYX is not Postiz or Gitroom and is not affiliated with them unless explicitly stated in writing. References to upstream open-source projects are made for attribution and license compliance, not to imply sponsorship or endorsement.
1.23Feedback
If you voluntarily provide suggestions, ideas, enhancement requests, or other feedback about the Service, you grant Lunark Dynamics LLC a worldwide, perpetual, irrevocable, royalty-free right to use, modify, commercialize, and incorporate that feedback without compensation or obligation, provided we do not publicly identify you as the source without permission.
1.24Privacy, Data Protection, and Customer Data
Our Privacy Policy explains how Lunark Dynamics LLC collects, uses, shares, retains, secures, and deletes personal data. When we process personal data contained in User Content or Workspace data on your documented instructions and applicable law treats us as your processor/service provider, the applicable data processing agreement, if any, is available at [DPA URL or DPA Request Process].
You remain responsible for determining whether the Service is appropriate for the personal data you choose to process and for complying with legal obligations applicable to you as a controller/business or equivalent role.
1.25Suspension
We may suspend all or part of the Service, a Workspace, an Account, a Connected Platform, scheduled publishing, or other functionality where reasonably necessary because of:
- a material or repeated breach of these Terms or the Acceptable Use Policy;
- non-payment, chargeback abuse, or suspected payment fraud;
- a security incident, credential compromise, abusive automation, excessive load, or threat to the Service or third parties;
- a Connected Platform request, platform-policy violation, platform access revocation, or risk to shared developer credentials;
- suspected unlawful conduct, sanctions/export-control concern, or a valid legal or regulatory requirement;
- conduct that creates material legal, security, operational, reputational, or platform-approval risk; or
- emergency maintenance or technical conditions that make continued operation unsafe or impracticable.
Where reasonable and lawful, we will provide notice and an opportunity to cure. We may act immediately without prior notice where necessary to prevent harm, comply with law or a platform requirement, or protect credentials, data, systems, users, or third parties.
1.26Termination and Effect of Termination
You may stop using the Service at any time. You may cancel a subscription as described above and may separately request Account deletion.
We may terminate these Terms or an Account for material breach, repeated abuse, non-payment after reasonable notice where appropriate, unlawful activity, severe security risk, or where continued provision is prohibited or made infeasible by law or a critical third-party dependency.
On termination, your right to use the Service ends. Scheduled actions may stop. Connected Platforms may be disconnected. Data is handled according to the Privacy Policy and Data Deletion Instructions. Sections that by their nature should survive termination — including payment obligations already incurred, intellectual-property provisions, disclaimers, liability limits, indemnity, dispute terms, and applicable confidentiality/privacy obligations — survive.
1.27Third-Party Services and Links
The Service may contain links to or integrations with third-party services. Their terms, privacy policies, availability, and practices are their own. We are not responsible for third-party content or services merely because POSTARYX links to or interoperates with them.
1.28Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” LUNARK DYNAMICS LLC DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, QUIET ENJOYMENT, ACCURACY, UNINTERRUPTED AVAILABILITY, ERROR-FREE OPERATION, SUCCESSFUL PUBLICATION, PRESERVATION OF DATA, OR COMPATIBILITY WITH ANY PARTICULAR CONNECTED PLATFORM.
We do not warrant that a scheduled post will publish at a particular time; that a platform will accept content; that a platform will approve, maintain, or restore API access; that analytics will be complete or identical to a platform’s native interface; that tokens will never expire or be revoked; or that beta/experimental connectors will remain available.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
1.29Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUNARK DYNAMICS LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS, LOST GOODWILL, LOST DATA, BUSINESS INTERRUPTION, FAILED OR DELAYED POSTS, PLATFORM PENALTIES, ACCOUNT SUSPENSION, LOSS OF PLATFORM ACCESS, OR COSTS OF SUBSTITUTE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.
As a drafting baseline preserved from V1, and subject to counsel review and mandatory law, our aggregate liability for claims arising out of or relating to the Service will not exceed the greater of: (a) amounts you paid to us for the Service during the three (3) months immediately before the event giving rise to the claim; or (b) USD 100.
The limitations apply to the maximum extent permitted by law and do not exclude liability that cannot lawfully be excluded or limited. [Counsel: confirm cap, carve-outs, consumer-law treatment, and whether a different cap is appropriate for enterprise contracts.]
1.30Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Lunark Dynamics LLC and its members, managers, employees, contractors, affiliates, and licensors from third-party claims, damages, losses, liabilities, penalties, costs, and reasonable legal fees arising from or relating to: (a) your User Content; (b) your or your Workspace users’ use of the Service; (c) your breach of these Terms or the Acceptable Use Policy; (d) your violation of law, platform rules, advertising/disclosure requirements, intellectual-property rights, privacy/publicity rights, or client obligations; (e) your lack of authority to manage a Connected Platform; or (f) disputes between you and your clients, employees, contractors, audience, or other third parties.
We will provide reasonable notice of an indemnified claim and may control the defense and settlement, subject to applicable law. You may not settle a claim in a manner that admits fault by or imposes obligations on us without our written consent.
1.31Governing Law and Disputes
These Terms are governed by the laws of [Governing Law State/Jurisdiction], excluding its conflict-of-law rules, except to the extent mandatory law requires otherwise.
Any dispute venue, court jurisdiction, arbitration requirement, class-action waiver, informal dispute process, or other dispute-resolution mechanism is: [Venue / Courts / Arbitration Terms].

1.32Changes to These Terms
We may update these Terms to reflect legal, product, security, pricing, operational, or platform-policy changes. The current version will display a “Last updated” date. For material changes, we will provide notice reasonably appropriate to the change, which may include email, in-product notice, or website notice.
Where a Connected Platform, regulator, security incident, or legal requirement demands immediate action, we may modify affected functionality or platform-specific terms before advance notice is practicable. Continued use after an updated version becomes effective constitutes acceptance where permitted by law.
1.33Electronic Communications
You consent to receive Service-related communications electronically, including receipts, security alerts, connection-health notices, failed-post notices, legal notices where permitted, and support messages. Marketing messages, if any, are subject to applicable consent and unsubscribe requirements.
1.34Assignment
You may not assign or transfer these Terms or your Account without our written consent, except as permitted in a written enterprise agreement. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, financing, or sale of all or substantially all assets relating to the Service, subject to applicable law and privacy obligations.
1.35Severability, Waiver, and Entire Agreement
If a provision of these Terms is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions remain effective. Failure to enforce a provision is not a waiver. These Terms, together with incorporated policies, applicable order forms, and any signed data processing or enterprise agreement, constitute the agreement between you and us concerning the Service and supersede prior agreements on the same subject, except where a signed agreement expressly controls.
